Conditions of Business

 

1. Subject of Conciliation

The Hotel & Event Service Ltd. facilitates room and board services and if so specified other relevant services. Such as, but not limited to, ticket sales, transfers, restaurant and catering services, guide services and other applicable program activities.

 

The Hotel & Event Service Ltd. mediates services and bills rendered by third party contractors. Therefore all contracts for services are exclusively generated between the client and the supplier of services. The Hotel & Event Service Ltd. simply mediates between the supplier of services and the client. The Hotel & Event Service Ltd. is only bound to the client through a mediation contract. The caveats of mediation are defined when room and board services are provided. Sidebar agreements that change the terms and conditions of mediation contract are only valid through written confirmation.

 

2. Booking and Contract Agreements

2.1 Utilizing the Hotel & Event Service Ltd. services, a binding agreement between the supplier of services and Hotel & Event Service Ltd. is created.  E.g. through the completion of an accommodation contract with Hotel & Event Service Ltd. a binding brokerage agreement that includes the brokerage terms and conditions is created.

2.2 The booking can be established through any method of contact which include but are not limited to written, verbal, telecommunication, or electronic contact.

 

3. Payment and completion of overnight services

3.1 During the booking process between the client and Hotel & Event Service Ltd. it can be agreed upon that the overnight price including the brokerage fees are paid before departure to Hotel & Event Service Ltd. The payment due dates are shown on the travel confirmation documents. After the payment is made to Hotel & Event Service Ltd. the booking is legally bound.

3.2 Otherwise, the travel confirmation documents will represent the overnight stay price which has to be paid directly at the hotel.

3.3 The client is responsible for direct payments to hotels, and to communicate payment with Hotel & Event Service GmbH if arrival is after 18:00.  Rights of compensation by third party contractors are upheld, as well as all brokerage fees for Hotel & Event Service Ltd, in accordance with article 5.2.

 

4. Payment and completion for entrance tickets

The ticket price including shipping and handling fees has to be paid by the client after transmission of the booking documents directly to Hotel & Event Service Ltd. After receipt of payment at Hotel & Event Service Ltd. the tickets will be shipped to the client.

 

5. Cancellation

5.1 At any time it is possible, with explanation to Hotel & Event Service Ltd., to cancel a contract. Cancellation must be stated with booking number. Any cancellation announcement must be in writing.

5.2 If the accommodation contract is cancelled or the booked rooms are not utilized, the service company may and can demand compensation, and the Hotel & Event Service Ltd. may demand the brokerage fees. Cancellation fees are to be paid immediately and with utilized service costs. The cost of the Cancellation fees is dependent on the date of the written cancellation communication and as outlined in the accommodation contract for prorated fees. Calculation of compensation fees include but are not limited to cost of unused services and loss of ability to rent out booked rooms.

 

6. Warranty / Liability

6.1 The Hotel & Event Service Ltd. is only a broker between the client and the third party and is not liable for the accurate implementation of services by the third party, only for the accurate brokerage with the third party. Hotel & Event Service Ltd. is not liable for the degree of performance of services by the third party.

6.2 The Hotel & Event Service Ltd. cannot guarantee for correctness of online dates supplied by the event planners. These dates are supplied by the event planners and they are liable for these.

6.3 The Hotel & Event Service Ltd. is liable for damage that can be considered a gross misconduct by the Hotel & Event Service Ltd., or a legal violation by The Hotel & Event Service Ltd. This is applicable for fatalities or body and health damage.

6.4 Any claims against the degree of performance of service by any contracted third party about contract violations are to be reported as soon as possible and exclusively to the correct party department of the service provider. If information on paperwork is not enough to identify the correct accommodation service or event planner, than the Hotel & Event Service Ltd. can be contacted for necessary information.

 

7. Severability Clause

Should any of these presented terms no longer be available or effective, the other terms are not effected by that, and are not to be touched.

 

8. Changes to the General Terms and Conditions of Business

The Hotel & Event Service Ltd. maintains the right to change the General Terms and Conditions of Business.

 

9. Legal Rights

Legal complaints against the Hotel & Event Service Ltd. are to be brought to the registered office. For legal complaints by The Hotel & Event Service Ltd., we reserve the right to use your residence, with the exception of claims against sales person(s), that have moved their residence out of the country after completion of business, or the place of residence is unknown. In this case the Hotel & Event Service Ltd. registered residence will be used.
